The “MIDDLEGO User Agreement” (hereinafter referred to as “this Agreement”) is concluded between you and the MIDDLEGO service provider, and this Agreement has contractual effect. Please be sure to read and fully understand the contents of each clause, especially the clauses exempting or limiting MIDDLEGO’s liability (hereinafter referred to as “exemption clauses”), the clauses restricting user rights (hereinafter referred to as “restriction clauses”), and the agreement on dispute resolution methods and jurisdiction clause, as well as a separate agreement to open or use a certain service. The aforementioned disclaimer, restriction, dispute resolution method and jurisdiction clauses may be bolded, and you should read all the clauses of this agreement in detail. If you agree to this agreement, you can continue to use MIDDLEGO services. Your clicking on agree, accept or next, or your registration and use of MIDDLEGO services shall be deemed as your having read and agreed to sign this agreement. If you are under the age of 18, please read this agreement accompanied by your legal guardian.

I. [Definitions]

1.1 This Agreement: Refers to this agreement and the “MIDDLEGO Privacy Protection Guidelines” and their revised versions. Once the above content is officially released, it will become an integral part of this agreement.

1.2 Rules: Refers to the user code of conduct, player regulations, announcements, prompts and notifications, etc. about MIDDLEGO issued and revised by the service provider from time to time.

1.3 MIDDLEGO Service Provider: Refers to MIDDLEGO, which provides you with MIDDLEGO services, referred to as “MIDDLEGO” or “we” in this agreement.

1.4 MIDDLEGO: Refers to the collective name of Go products operated by MIDDLEGO, including computer clients, web pages, HTML5 (H5) services, mobile terminals, and other forms of products.

1.5 MIDDLEGO Services: Refers to the various online operation services provided to you by MIDDLEGO.

1.6 You: Also known as “user”, refers to a natural person who is authorized to use MIDDLEGO and its services.

1.7 User Data: Refers to various data generated by you during the use of MIDDLEGO and recorded by the server, including but not limited to account data, virtual item data, behavior logs, and other data.

1.8 Virtual Props: Refers to a service provided by MIDDLEGO, which is stored in the server running the program in the form of electromagnetic records, can realize the specific functions set by the program or reflect the specific results of the program running, and can be expressed in words, graphics or other digital forms. Virtual props are part of the MIDDLEGO service.

II. Acquisition of Software

2.1 You can directly obtain the software from MIDDLEGO’s official website, official application distribution platform, and MIDDLEGO authorized third-party websites, application distribution platforms and other channels.

2.2 If you obtain this software or an installation program with the same name as this software from a third party not authorized by MIDDLEGO, we cannot guarantee that the software can be used normally, and we will not be responsible for any losses caused to you thereby.   

III. Installation and Uninstallation of Software

3.1 MIDDLEGO may develop different software versions for different terminals, systems, etc. You should choose to download and install the appropriate version according to the actual situation.

3.2 After downloading the installation program, you need to install it correctly according to the steps prompted by the program.   

IV. Software Updates

4.1 In order to improve user experience or service security, MIDDLEGO has the right to update the software, or change the functional effects of part of the software.

4.2 After the new version of the software is released, the old version of the software may not be available. We do not guarantee that the old version of the software will continue to be available and continue to provide corresponding customer service for the old version of the software. Please check and download the latest version at any time.   

V. Protection of User Personal Information

5.1 Protecting user personal information is one of our basic principles. We will collect and use your personal information in accordance with this agreement, the “MIDDLEGO Privacy Protection Guidelines”, and the privacy protection guidelines (if any) related to this software and services.

5.2 You should fully respect the personal information of anyone, including but not limited to other users, that you understand, receive or may come into contact with through this software and related services. You should not collect, copy, store, disseminate or use other users’ personal information in any other way, otherwise, you will bear the consequences arising therefrom.

VI. Main Rights and Obligations Clauses

6.1 Account Usage Norms

If you use a third-party account to log in and enjoy MIDDLEGO’s services, you should also abide by the agreements and rules related to the third-party account, and you should contact the third party to resolve related issues arising from the third-party account, including but not limited to theft, etc. MIDDLEGO can provide help as appropriate.

You acknowledge and agree that in the guest mode, once you uninstall or reinstall this software, or you change your mobile phone, computer or other terminal equipment or such terminal equipment is damaged, all relevant data in the guest mode may be cleared, and cannot be queried and restored. If you suffer any loss as a result, you shall bear it yourself.

6.1.2 You fully understand and agree that MIDDLEGO has the right to verify whether the identity information provided by the user during registration is true and valid according to the requirements of laws and regulations, and should actively take technical and management and other reasonable measures to ensure the security and effectiveness of the user’s account; The user has the obligation to properly keep his account and password, and use his account and password correctly and safely. If any party fails to fulfill the above obligations, resulting in the loss of account password, account theft, etc., which causes damage to the civil rights of the user and others, it shall bear the legal responsibility arising therefrom.

6.2 In order to provide you with effective services, you hereby license MIDDLEGO to use the processor, bandwidth and other resources of your computer and mobile communication terminal. During the use of this software, data traffic fees may be incurred. Users need to understand the relevant tariff information from the operator by themselves, and bear the relevant fees by themselves.

6.3 You fully understand and agree: When you use a specific function or service of this software, this service may need to use the relevant permissions of your terminal device to realize the corresponding functions, and we will obtain your consent according to law before use. The specific function or service may have a separate agreement, relevant business rules, etc. (hereinafter collectively referred to as the “separate agreement”). Please read and agree to the relevant separate agreement before using the function or service; Your use of the aforementioned specific functions or services shall be deemed as your acceptance of the relevant separate agreements.

6.4 When users use this software and services, they must bear the risks caused by unstable network signals, small network bandwidth, etc., which cause the software to fail to log in, incomplete data synchronization, and slow page opening speed.

6.5 You agree that MIDDLEGO will send you commercial advertisements, promotions or promotional information. If MIDDLEGO sends you commercial advertisements, promotions or promotional information involving the use of your personal information, we will comply with relevant laws and regulations and the “MIDDLEGO Privacy Protection Guidelines”.

6.6 When you use products or services provided by third parties in this software, in addition to complying with the provisions of this agreement, you should also comply with the user agreement of the third party. MIDDLEGO and the third party shall bear their respective responsibilities within the scope stipulated by laws and agreements for possible disputes.

Unless otherwise stipulated by law, MIDDLEGO does not guarantee or assume joint and several liability for the security, accuracy and effectiveness of the services and content provided by third parties. If any disputes and damages arise therefrom, the third party shall bear the responsibility. If you use third-party products or services, you may need to disclose your relevant personal information to the third party during the use process. MIDDLEGO hereby reminds you to make a careful decision when disclosing your personal information.

6.7 If you need to cancel your MIDDLEGO account, you can follow the account cancellation instructions provided by the official.

At the same time, we also remind you that if you cancel your account, we will no longer save all your data and personal information. Virtual props and other value-added services under the account will also be cleared. Accordingly, before you cancel your account, please make sure that the income under the account has been properly handled and settled. Once you cancel your account, it shall be deemed that you voluntarily give up all income under the account, and MIDDLEGO has the right to clear all income under the account, and you shall bear the consequences arising therefrom.

VII. User Code of Conduct

7.1 Information Content Norms

7.1.1 If you use this software and service to upload, publish or publish opinions, data, text, information, usernames, pictures, photos, personal information, audio, video files, links and other content (hereinafter collectively referred to as “information content”), you guarantee that you have the full right to upload, publish or publish such information content or have obtained the legal authorization of the relevant obligee, and such information content does not infringe the legitimate rights and interests of MIDDLEGO and any third party, and there is no any illegal or non-compliant situation.   

7.1.2 When using this service, you must abide by laws and regulations,

and must not produce, copy, publish, or disseminate information content containing the following content or engage in related behaviors, nor provide convenience for producing, copying, publishing, or disseminating information content containing the following content or engaging in related behaviors:

(1) Inciting ethnic hatred and ethnic discrimination;

(2) Spreading rumors and disrupting social order;

(3) Spreading obscenity, pornography, gambling, violence, homicide, terror or instigating crimes;

(4) Insulting or slandering others, infringing on the legitimate rights and interests of others;

(5) Other content prohibited by laws and regulations.

7.2 Unless permitted by law or MIDDLEGO’s written permission, you shall not engage in the following behaviors during the use of this software:

(1) Delete the copyright information on this software and its copies;

(2) Reverse engineer, decompile, or decompile this software, or try to discover the source code of this software in other ways;   

(3) Use, rent, lend, copy, modify, link, reprint, compile, publish, publish, establish mirror sites, etc. for the content of MIDDLEGO’s intellectual property rights;   

(4) Copy, modify, add, delete, connect and run or create any derivative works of this software or the data released to any terminal memory during the operation of this software, the interactive data between the client and the server during the operation of the software, and the system data necessary for the operation of this software, including but not limited to using plug-ins, plug-ins or third-party tools/services not authorized by MIDDLEGO to access this software and related systems;   

(5) Modify or falsify the instructions and data in the software operation, increase, delete, or change the functions or operating effects of the software, or operate or disseminate to the public the software or methods used for the above purposes, regardless of whether these actions are for commercial purposes;

(6) Log in or use MIDDLEGO and its services through third-party software, plug-ins, plug-ins, and systems not authorized by MIDDLEGO, or produce, publish, and disseminate the above tools;

(7) Interfere with this software and its components, modules, and data by yourself or authorize others or third-party software;

(8) Use program loopholes to gain benefits, destroy the game environment or cause adverse effects on other players;

(9) Steal other people’s accounts and data;

(10) Conduct account transactions, account sharing and other behaviors that affect account security;

(11) Trade virtual props and other value-added services with other users without the permission of MIDDLEGO, or obtain virtual props and other value-added services from a third party by purchasing, accepting gifts or other methods;

(12) Recharge on discount channels not authorized or recognized by MIDDLEGO, entrust a third party not authorized or recognized by MIDDLEGO to recharge on behalf of, or use third-party software not authorized or recognized by MIDDLEGO to recharge;

7.3 You fully understand and agree that you must be responsible for all your actions in using this service and registering your account, including any content you publish and any consequences arising therefrom. You should judge the content in this service by yourself, and bear all risks arising from the use of the content by yourself.

If MIDDLEGO receives a notice from the obligee claiming that the content you send or disseminate infringes its relevant rights, you agree that MIDDLEGO has the right to make independent judgments and take measures such as deleting, shielding or disconnecting links. You must not violate national laws and regulations or infringe on the legitimate rights and interests of others when using this service or this software.

You understand and agree that if you are complained of infringement by others or you complain of infringement by others, MIDDLEGO has the right to provide necessary information such as the subject, contact information, and complaint-related content of the relevant parties in the dispute to other disputing parties or relevant departments in order to timely resolve complaints and disputes, and protect the legitimate rights and interests of others or you.

7.4 You understand and agree: If you violate the provisions of this agreement, MIDDLEGO has the right to take one or more of the following processing measures according to your breach of contract, and announce the processing results:

(1) Warning; and/or

(2) Banning words, including but not limited to banning words in the whole area, banning words in a single area, and banning words in public channels; and/or

(3) Content reset, including but not limited to resetting or forcibly modifying illegal nicknames, room names, pictures and other illegal information or content provided or uploaded by you; and/or   

(4) Reduce or restrict your income, which includes but is not limited to the improvement of all data in MIDDLEGO (such as task income, rankings) and the acquisition of other virtual props and value-added services; and/or   

(5) Delete or cancel accounts, data or other relevant information; and/or

(6) Restrict or prohibit you from entering specific scenes or using specific functions in the software; and/or

(7) Force quit (ie “kick out”), including but not limited to force quit the entire software, single game or other actions you are doing; and/or

(8) Temporarily or permanently prohibit your account from logging in to MIDDLEGO (hereinafter referred to as “banning”); and/or

(9) Temporarily or permanently prohibit the specific terminal (including but not limited to PC terminal, mobile terminal, etc.) involved in your illegal activities from logging in to MIDDLEGO; and/or

(10) Suspend or terminate your use of MIDDLEGO and related services, or unilaterally notify you to terminate this agreement; and/or

(11) File a corresponding civil lawsuit for your illegal and illegal activities, pursue your tort, breach of contract or other civil liabilities, and require you to compensate MIDDLEGO for the losses suffered due to your illegal and illegal activities (including MIDDLEGO The company’s direct economic losses, reputation or goodwill losses, compensation, settlement expenses, attorney fees, litigation costs and other indirect losses paid to the outside world), or transfer to relevant administrative authorities for administrative penalties, or transfer to judicial authorities to pursue your criminal responsibility; and/or   

(12) Other handling measures announced by MIDDLEGO (including but not limited to user code of conduct, player regulations, announcements, prompts and notifications).

You acknowledge and agree that due to the concealment of cheating behaviors such as plug-ins and the use of artificial intelligence (AI) to play games, MIDDLEGO has the right to judge whether you have used illegal plug-ins or involved in AI cheating behaviors based on your behavior data and abnormal performance.

7.5 Acknowledge and agree that if MIDDLEGO takes account banning measures on your account in accordance with this agreement, the specific banning period will be determined by MIDDLEGO according to the circumstances of your violation.

You acknowledge and agree: (1) During the account banning period, the virtual props and other value-added services in your account will not be available; (2) If the aforementioned virtual props and other value-added services have a certain validity period, the validity period may expire during the account banning period, and after your account is unbanned, you will not be able to use such expired virtual props and other value-added services.

7.6 Understand and agree that MIDDLEGO has the right to take corresponding processing measures against your violations and take appropriate legal actions based on its own reasonable judgment, and save relevant information and report to relevant departments in accordance with laws and regulations, and users should bear all legal responsibilities arising therefrom alone.   

If you violate the provisions of this agreement, resulting in or generating any claims, demands or losses claimed by a third party, you shall bear the responsibility independently. If MIDDLEGO suffers losses as a result, you should also compensate together.

VIII. Intellectual Property Statement

8.1 MIDDLEGO is the owner of the intellectual property rights of this software. All copyrights, trademarks, patents, trade secrets and other intellectual property rights of this software, as well as all information content related to this software (including but not limited to text, pictures, audio, video, charts, interface design, layout framework, related data or electronic documents, etc.) are protected by the laws and regulations of the People’s Republic of China and corresponding international treaties. MIDDLEGO enjoys the above intellectual property rights, except for the rights that the relevant obligees should enjoy in accordance with the law.   

8.2 Without the written consent of MIDDLEGO or relevant obligees, you shall not implement, utilize, or transfer the aforementioned intellectual property rights for any commercial or non-commercial purpose by yourself or authorize any third party to do so.   

IX. Terminal Security Responsibility

9.1 You understand and agree that, like most Internet software, this software may be affected by a variety of factors (including but not limited to user reasons, network service quality, social environment, etc.); It may also be plagued by various security problems. Therefore, you should strengthen your awareness of information security and personal information protection, and pay attention to password protection to avoid losses.   

9.2 You must not make, publish, use, or disseminate malicious programs used to steal user accounts and other people’s personal information and property.

9.3 Under no circumstances should you easily believe in online information about borrowing money, asking for passwords or other property-related matters. For property operations, please be sure to verify the identity of the other party first, and please always pay attention to the tips on preventing fraud crimes.

X. Third-Party Software or Technology

10.1 If this software uses third-party software or technology, you must comply with the relevant agreements and rules of such third-party software or technology. If you fail to comply, the third party may take legal action or other measures against you and request MIDDLEGO to provide assistance, and you will bear the legal responsibility on your own. 10.2 Any disputes arising from the use of third-party software or technology in this software shall be resolved by the third party, and MIDDLEGO shall not bear any liability to the extent permitted by law.

XI. Disclaimer

11.1 You understand and agree that MIDDLEGO has the right to repair, maintain, or upgrade the platform or related equipment that provides this service in order to provide you with better services. Such actions may result in the temporary interruption or suspension of relevant services within a reasonable period, and MIDDLEGO shall not be liable for any losses you may suffer as a result, within the limits of the law. 11.2 You understand and agree that MIDDLEGO’s services are provided based on the current state of technology and conditions. MIDDLEGO will make every effort to provide you with services and ensure continuity and security, but MIDDLEGO cannot guarantee that the services provided are flawless, nor can it predict and prevent risks such as technical failures or other issues that may cause service interruptions, data loss, or other losses and risks. Except as otherwise provided by law, MIDDLEGO shall not be liable for any losses you suffer as a result. 11.3 You understand and agree that during your use of this service, you may encounter risks such as force majeure that may cause service interruptions. Force majeure includes but is not limited to natural disasters such as floods, earthquakes, pandemics, and storms, as well as social events such as wars, unrest, and government actions (including acts by legislative, administrative, and judicial bodies, or acts by organizations authorized by national laws, regulations, or policies to manage public affairs). In such cases, MIDDLEGO will make every effort to cooperate with relevant parties to restore the service as soon as possible, but MIDDLEGO is exempt from liability for any losses you suffer to the extent permitted by law. 11.4 To the extent permitted by law, MIDDLEGO is not liable for service interruptions or obstructions caused by the following: (1) Destruction by computer viruses, Trojans, or other malicious programs, or hacker attacks; (2) Malfunctions in the user’s or MIDDLEGO’s computer software, systems, hardware, or communication lines; (3) User error; (4) Outdated software versions, aging equipment, and/or compatibility issues with the user’s devices; (5) Other circumstances that are beyond control or reasonably unforeseeable.

XII. Suspension or Termination of Service

12.1 If you notify MIDDLEGO in writing that you do not accept this agreement or any modifications to it, MIDDLEGO may suspend or terminate all or part of the services provided to you. 12.2 If force majeure prevents you from continuing to use the service or MIDDLEGO from providing the service, either party has the right to terminate the agreement at any time. 12.3 If other conditions for suspension or termination as specified in this agreement occur, MIDDLEGO may suspend or terminate all or part of the services provided to you. 12.4 All data generated during your use of the software and related services are owned by MIDDLEGO, and MIDDLEGO has the right to retain and dispose of the data, except as otherwise provided by national laws and regulations. MIDDLEGO is entitled to the property rights of data products and services legally processed from such data, as provided by law.

XIII. Miscellaneous

13.1 Your use of this software or service is deemed as your acceptance of this agreement and its binding terms. MIDDLEGO has the right to modify the terms of this agreement when necessary. You can view the latest version of the agreement on the relevant service page. If you continue to use the software or services provided by MIDDLEGO after the changes to the agreement, it is deemed that you have accepted the modified agreement. 13.2 The formation, validity, performance, interpretation, and dispute resolution of this agreement are governed by the laws of mainland China (excluding conflict of laws). 13.3 Any disputes or conflicts arising from or related to this agreement between you and MIDDLEGO shall first be resolved through friendly negotiations; if negotiations fail, you agree to submit the disputes or conflicts to the people’s court with jurisdiction in the location where this agreement was signed. 13.4 The titles of all clauses in this agreement are provided for ease of reading only and have no actual meaning. They cannot be used as a basis for interpreting the meaning of this agreement. 13.5 If any part of this agreement is invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding on both parties.
